of from 6 to 12 years, unanimously reversed, on the law, with leave to represent the charge of robbery in the third degree
to a Grand Jury. Defendant was convicted of first degree robbery under a single-count indictment. The crime occurred on January 23, 1990 at
approximately 2:00 a.m. in the bar owned by complainants. An owner identified defendant from a photograph and at two separate
line-ups.
